Welcome to Navicater ("we," "our," or "us"). Navicater is a social knowledge-sharing platform designed specifically for seafarers, maritime professionals, students, and aspirants. This Terms of Service ("Agreement") governs your use of our products, features, apps, services, technologies, and software (collectively referred to as the "Platform").

By accessing or using Navicater, you agree to be bound by this Agreement. If you do not agree, please do not use our Platform.

1. User Eligibility and Account Registration

You may use Navicater only if you:

  • Are at least 17 years old (or the minimum age required in your country).
  • Have not been previously banned for violating our policies.
  • Use accurate identity and professional details when creating a profile.

You are responsible for maintaining the confidentiality of your account and for all activities that occur under it. You must keep your profile and contact information up to date.

2. Platform Overview

Navicater provides a specialized space for:

  • Maritime Knowledge Sharing: Ask questions, share experiences, and contribute to maritime discussions.
  • Professional Networking: Build your maritime profile and connect with industry peers.
  • Community Engagement: Participate in topic-based groups/forums, and aspirant support/mentor channels.
  • Maritime Tools & Info Access: View port data, ship data, and other seafarer-relevant content aggregated from public sources.

3. User Content and Conduct

a. Content Ownership

You retain ownership of the content you post. By posting content on Navicater, you grant us a non-exclusive, worldwide, transferable, sublicensable license to use, display, reproduce, and distribute that content to support the Platform's functionality.

b. User Responsibilities

You agree to:

  • Share only content that complies with applicable laws and our guidelines.
  • Respect others' intellectual property.
  • Avoid posting misleading, harmful, defamatory, or offensive material.
  • Refrain from harassment, spam, and misuse of the Platform.
  • Avoid using bots, scrapers, or other automated methods.

Disclaimer: Navicater cannot be held responsible for the views, solutions, or advice provided by users. These are based on individual experiences and competencies and should be used with caution. Users are advised not to blindly implement any suggestions and instead assess them in the context of their specific situations or seek expert validation.

4. Content Monitoring and Safety

  • Our team actively monitors the Platform and removes malicious profiles or misleading content upon detection or user reports.
  • Users are encouraged to report suspicious behavior or content. Immediate action will be taken to ensure a safe and respectful environment.

5. Data Accuracy and Source Disclaimer

  • Information such as port details, ship details, and similar maritime data are aggregated from publicly available online sources.
  • While we strive to keep this data accessible and useful, Navicater does not verify or guarantee the accuracy or timeliness of such content.
  • This information is shared only to assist users and should not be relied upon for navigation, operations, or commercial decisions.

6. Privacy and Data Use

We collect and use data as outlined in our Privacy Policy. By using the Platform, you consent to:

  • Our collection and use of personal data to personalize your experience (e.g., feeds, advertisements).
  • The public or network-specific sharing of your content based on your settings.
  • Optional third-party integrations (e.g., maritime portals, tools).

We do not sell your personal data without your consent.

7. Professional Use and Profile Policy

  • Your profile must accurately reflect your qualifications, training, and sea service (if applicable).
  • You may not claim credentials or experiences that are unverifiable or false.
  • Soliciting services or promotions must comply with Platform rules and be conducted respectfully.

We reserve the right to verify credentials and remove profiles that violate these terms.

8. Platform Integrity and Security

You may not:

  • Disrupt or interfere with the operation of the Platform.
  • Gain unauthorized access to other accounts.
  • Upload or distribute viruses or malicious code.
  • Hold us liable for any non-availability or outage of services.

We implement industry-standard security protections, but we cannot guarantee complete security or loss prevention of user data.

9. Termination

We may suspend or terminate your account if:

  • You violate these Terms or community guidelines.
  • You engage in unlawful, misleading, or unsafe conduct.
  • Required by legal or regulatory authorities.

You may delete your account at any time by accessing the Settings section within the app. Once the deletion request is submitted, your account will be deactivated, and your profile and associated content will be removed from public view.

Your account will remain in a deactivated state for 30 days, during which you may choose to reactivate your account by logging in. If no action is taken during this period, your account and all associated personal data will be permanently deleted.

Please note that after the 30-day period, account deletion is irreversible and any data associated with the account will no longer be recoverable.

10. Disclaimers and Limitation of Liability

Navicater is provided "as is" and "as available." We make no warranties regarding:

  • The accuracy or applicability of user-generated content.
  • The precision of data (including maritime or location-based data).
  • The results of advice, connections, or discussions on the Platform.

We are not liable for any direct or indirect damages, including but not limited to accidents, injuries, or financial losses that may result from the use or misuse of content found on Navicater.

11. Changes to These Terms

We may update this Agreement periodically. Significant changes will be notified via the Platform. Continued use after updates constitutes your acceptance.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of British Columbia, Canada. Any disputes shall be resolved through arbitration or courts located in British Columbia, Canada, unless otherwise required by law.
